When an individual becomes romantically involved with a person under the legal age of consent, they face being charged with statutory rape. These charges are serious and are defined clearly by Texas law. A person commits this type of crime if they:

  • Penetrate the anus or sexual organ of a child in any way
  • Penetrate the mouth of a child with their own sexual organ
  • Cause the sexual organ of a child to penetrate the mouth, anus, or sexual organ of themselves or another person

Sentencing for Statutory Rape

There are two main types of statutory rape charges. These two include:

  • Sexual assault: This crime is charged as a second-degree felony and carries a sentence of two to 20 years in prison and a fine of no more than $10,000.
  • Aggravated sexual assault: This type of charge most often occurs when the child is under the age of 14. While a person who is 17 years of age can be married and have sex with their spouse, a person age 14 and under cannot consent to sex under any circumstances. The sentence for this type of crime is five to 99 years in prison and a fine of no more than $10,000.

There are some cases in which the defendant can receive a sentence as light as probation. These types of cases often involve mitigating circumstances. Even in cases like these, the defendant is still required to register as a sex offender for the rest of their life.

Statutory rape charges can be challenged based on multiple factors. The prosecution must prove beyond a reasonable doubt that the defendant is guilty. In cases such as statutory rape, this isn’t as clear as it sometimes seems.
