The state of Texas takes aggravated sexual assault charges very seriously and gives heavy sentences to prove this. A crime is considered to be aggravated sexual assault if certain circumstances surround the crime, including:

  • The alleged victim was afraid of serious bodily injury or death.
  • The crime involved a person under the age of 14.
  • The crime involved a person who is disabled or elderly.
  • Drugs were administered to the victim during the crime.
  • The alleged suspect caused serious bodily injury or death to the victim.
  • A deadly weapon was used during the crime.

False charges that sometimes arise from these crimes are usually the result of one person trying to ruin another’s reputation or gain some form of compensation in return for dropping the charges.

Sentencing for Aggravated Sexual Assault Crimes

There are a variety of factors that can affect the sentencing of this type of crime, but it is always charged as a first-degree felony. A first-degree felony carries with it a sentence of five to 99 years in prison and a fine of no more than $10,000. Other factors that may alter the sentence include:

  • The victim is under the age of six at the time of the crime. This has a minimum sentence of 25 years in prison.
  • The victim is under the age of 14 at the time of the crime, and an attempt was made to seriously harm the victim with a weapon or controlled substance.

A person who is convicted of aggravated sexual assault will face many obstacles in their personal life, including:

  • Registration as a sex offender
  • Inability to obtain certain jobs or pursue certain educational programs
  • Revoked right to vote or own a firearm
